These Terms & Conditions apply to photographic safari bookings made through Dereck Hindry Photography (“DHP”).

By registering for a tour, paying a deposit or making any other payment toward a booking, you acknowledge that you have read, understood and accepted the Terms & Conditions applicable to your booking.
These Terms & Conditions may be amended from time to time. The terms applicable to your booking will be those provided or made available to you in connection with your booking, subject always to any rights you may have under applicable law.
Dereck Hindry is an Official Agent for Australia and New Zeeland for “CNP Safaris” (reg. 2015/138225/07),referred to in these Terms and Conditions as “CNP Safaris”.
1.TYPES OF BOOKINGS
Dereck Hindry Photography offers two types of photographic safari bookings.
Tours Hosted by Dereck Hindry Photography
Where a photographic tour is advertised as being hosted or led by Dereck Hindry Photography, the client books with DHP and these Terms & Conditions apply.
DHP-led tours are led by Dereck Hindry, with all the ground services provided by “CNP Safaris” as an independent supplier to DHP. The clients contract is with DHP not with “CNP Safaris”.
“CNP Safaris” Operated or Hosted Tours
Where DHP arranges a safari for a client that is operated or hosted by “CNP Safaris” or its appointed photographers or guides, DHP acts as the Australian booking agent for that safari.
Payment by the client is done directly to “CNP Safaris”.
The underlying tour is operated by “CNP Safaris” and is subject to the applicable “CNP Safaris” Terms & Conditions, including its registration, payment, cancellation, refund, itinerary and operational conditions.
Clients will be advised when their booking is for a “CNP Safaris” operated or hosted tour and will be provided with, or directed to, the applicable “CNP Safaris” Terms & Conditions.
2.REGISTRATION AND CONFIRMATION
For a DHP-hosted tour, registration is confirmed once DHP has received:
-
the required booking information;
-
the applicable 35% deposit; and
-
any additional documentation reasonably required for the tour. All bookings are subject to availability.
A provisional reservation may be held for up to 14 days. The booking will only become confirmed upon receipt of the required deposit and written confirmation from DHP.
Payment of the deposit constitutes acceptance of these Terms & Conditions.
For “CNP Safaris” operated tours, registration and confirmation will also be subject to the applicable “CNP Safaris” Terms & Conditions.
3.DEPOSIT AND PAYMENT SCHEDULE
Unless otherwise stated in writing for a particular tour, the following payment schedule applies to tours hosted by DHP:
At the time of booking:
35% of the total tour price.
180 days before the tour start date:
A further 35% of the total tour price.
90 days before the tour start date:
The remaining 30% of the total tour price.
The initial 35% deposit is non-refundable, subject to any rights or remedies that cannot lawfully be excluded under applicable Australian law.
Bookings Made Within 180 Days
If a booking is made within 180 days of the tour start date, 70% of the total tour price is payable to confirm the booking.
The remaining 30% is payable 90 days before departure. Bookings Made Within 90 Days
If a booking is made within 90 days of the tour start date, 100% of the total tour price is payable at the time of booking.

Payments are made in USD. Any conversion from the client’s own currency is at the clients cost and risk.
The applicable currency will be clearly identified before booking.
Unless expressly stated otherwise, advertised tour price is per person sharing.
DHP reserves the right, where reasonably necessary and subject to applicable law, to adjust the price of a tour before final payment where there has been a material increase in costs outside DHP’s reasonable control, including currency fluctuations, park fees, conservation levies, transportation costs, government taxes or similar supplier charges.
Where a price adjustment is necessary, affected clients will be notified as soon as reasonably practicable.
5.PAYMENT METHODS
Payment instructions will be provided at the time of booking.
Any bank charges, international transfer charges, credit card processing fees or similar transaction costs that apply to a particular payment method will be disclosed where applicable.
6.CANCELLATION BY THE CLIENT
All cancellations must be submitted to DHP in writing.
Unless otherwise stated in the applicable tour booking conditions, the following cancellation charges apply to DHP-hosted tours.
More Than 180 Days Before Departure
The initial 35% deposit is non-refundable. Between 180 and 90 Days Before Departure
The initial deposit plus an additional 30% of the total tour price is forfeited, resulting in a total cancellation charge of 65% of the total tour price.
Less Than 90 Days Before Departure
100% of the total tour price is forfeited.
Unless cancellation notice is received before an applicable balance payment becomes due, that payment may remain due and payable in accordance with the applicable cancellation conditions.
No refund will ordinarily be provided where a participant:
-
fails to join the tour on the scheduled start date;
-
joins the tour after it has commenced;
-
voluntarily leaves before completion; or
-
is unable to participate for personal, medical or travel-related reasons.
Participants should submit eligible losses arising from these circumstances to their travel insurer.
Nothing in this section excludes or limits any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
For “CNP Safaris” operated tours, the applicable “CNP Safaris” Cancellation and Refund Policy will apply.
7.TRAVEL INSURANCE
Comprehensive travel insurance is mandatory for participants on DHP-hosted international tours.
Participants must obtain appropriate insurance covering the entire duration of their travel and the activities included in the itinerary.
The policy should provide appropriate cover for circumstances including:
-
trip cancellation;
-
trip curtailment or interruption;
-
overseas medical and emergency expenses;
-
personal accident, injury or death;
-
baggage and personal possessions;
-
photographic and electronic equipment;
-
travel delays and disruption; and
-
other reasonably foreseeable travel risks relevant to the destination and activities.
Participants are responsible for ensuring that their chosen policy provides sufficient cover for their individual circumstances and the value of their photographic equipment.
DHP may request evidence of appropriate travel insurance before departure.
Failure to obtain required travel insurance may result in the participant being unable to join the tour.
8.MEDICAL AND HEALTH REQUIREMENTS
Participants are responsible for taking appropriate health precautions and should obtain professional medical advice concerning their destination before travelling.
Travel to Africa and other wildlife destinations may involve exposure to tropical diseases, including malaria, depending upon the destination and time of year.
Participants are responsible for obtaining appropriate advice regarding vaccinations, preventative medication and other health precautions.
Participants should advise DHP before departure of any medical, mobility or other condition that may materially affect their ability to participate safely in the tour.
9.ITINERARY CHANGES, DELAYS AND CANCELLATIONS
Photographic safaris frequently operate in remote areas where itineraries can be affected by circumstances beyond the reasonable control of DHP or its suppliers.
DHP therefore reserves the right, where reasonably necessary, to modify tour dates, itineraries, accommodation, transportation arrangements, activities or the allocated photographic guide or host.
Changes may become necessary because of circumstances including severe weather, road conditions, lodge availability, transportation delays, government action, illness, safety considerations, political circumstances or other events beyond reasonable control.
Where practicable, DHP will endeavour to provide a reasonable alternative.
Any additional costs resulting from delays or itinerary changes outside DHP’s reasonable control may be the responsibility of the participant, subject to applicable law.
Cancellation of a Tour by DHP
DHP reserves the right to cancel a hosted tour before departure where it cannot reasonably proceed, including where minimum participant numbers have not been achieved or logistical circumstances prevent the tour from operating as planned.
Where cancellation is being considered because minimum participant numbers have not been achieved, DHP will endeavour to make a decision no later than 45 days before the scheduled departure date.
Any refund, credit or alternative arrangement will depend upon the circumstances of the cancellation, amounts recoverable from suppliers and the participant’s rights under applicable law.
DHP is not responsible for consequential expenses incurred independently by a participant in preparation for a tour, such as non-refundable airfares, visas, passports, vaccinations, clothing or equipment, except where responsibility cannot lawfully be excluded.
10.CNP SPECIALIST PHOTOGRAPHIC BOATS AND VEHICLES
Certain tours may include access to “CNP Safaris”’ specialist custom-built photographic boats or safari vehicles.
These specialist vehicles and boats are maintained and serviced by “CNP Safaris”. However, mechanical breakdowns and other operational circumstances can occur.
Where a specialist photographic boat or vehicle becomes unavailable, it may be necessary to substitute a standard safari vehicle, boat or other suitable alternative.
The temporary or unavoidable substitution of a specialist photographic vehicle or boat does not automatically entitle a participant to a refund, subject to the participant’s rights under applicable law.
11.THIRD-PARTY SUPPLIERS AND LIABILITY
DHP-hosted tours may involve services supplied by independent third parties, including “CNP Safaris”, lodges, hotels, airlines, transport operators, guides, boat operators and other local service providers.
DHP takes reasonable care in selecting and arranging suppliers for its hosted tours but does not directly control the day-to-day operations of independent suppliers.
Travel and wildlife activities involve inherent risks. Participants accept the ordinary risks associated with the activities in which they voluntarily participate.
To the extent permitted by law, DHP is not responsible for loss, damage, delay, injury or expense caused by events outside its reasonable control or by independent third-party suppliers.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified.
12.PASSPORTS, VISAS AND ENTRY REQUIREMENTS
Each participant is responsible for ensuring that they hold a valid passport and all visas, permits and other documentation necessary for the countries included in their itinerary.
Participants are responsible for checking current immigration, health, vaccination and entry requirements.
DHP may provide general assistance or information, but participants remain responsible for confirming the requirements applicable to their individual circumstances.
13.WILDLIFE AND PHOTOGRAPHIC OPPORTUNITIES
Wildlife is wild and its behaviour cannot be controlled or predicted.
Neither DHP nor its suppliers can guarantee sightings of any particular animal, bird, species, behaviour or photographic opportunity.
Weather, water levels, vegetation, wildlife movements and environmental conditions may affect sightings and photographic opportunities.
The absence of a particular wildlife sighting or photographic opportunity does not, by itself, constitute a failure to provide the tour.
14.PHOTOGRAPHIC EQUIPMENT
Participants are responsible for their own cameras, lenses, computers, storage devices and other photographic equipment.
Participants should ensure that their travel insurance provides adequate cover for the replacement value of their equipment.
DHP is not responsible for loss of or damage to photographic equipment except to the extent that liability cannot lawfully be excluded.
15.SAFETY AND PARTICIPANT RESPONSIBILITY
Wildlife safaris take place in natural environments and may involve close proximity to wild animals.
Participants must comply with reasonable safety instructions given by the photographic host, professional guides, lodge staff, boat operators and other authorised personnel.
Participants must not leave vehicles, boats or designated areas unless instructed that it is safe to do so by an authorised guide.
16.PARTICIPANT CONDUCT
Small-group photographic tours depend upon cooperation and consideration between participants.
Participants are expected to behave responsibly and respectfully toward fellow participants, photographic hosts, guides, staff, local communities, wildlife and the environment.
DHP reserves the right, acting reasonably and subject to applicable law, to take appropriate action where a participant’s conduct creates a serious safety risk or materially disrupts the experience of other participants.
17.IMAGES, VIDEO AND TESTIMONIALS
Photographs and video may be taken during DHP-hosted tours and may be used for promotional purposes, including DHP’s website, advertising, printed material and social media.
Participants who do not wish to appear in promotional photographs or video should advise DHP or the tour leader at or before the commencement of the tour.
Written reviews or testimonials voluntarily provided to DHP may be used for promotional purposes, subject to applicable privacy and consumer laws.
18.COMPLAINTS
If a problem occurs during a tour, participants should raise the matter with DHP, the tour leader or the relevant supplier as soon as reasonably possible so that an opportunity is provided to address the issue.
Any unresolved complaint should be submitted to DHP in writing following the tour.
19.AUSTRALIAN CONSUMER LAW
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or any other applicable legislation where that guarantee, right or remedy cannot lawfully be excluded, restricted or modified.
20.WHICH TERMS APPLY TO YOUR BOOKING?
For a tour hosted or led by Dereck Hindry Photography, these Terms & Conditions, together with the applicable itinerary, quotation and booking confirmation, apply to the booking.
For a tour operated or hosted by “CNP Safaris” or its appointed photographic leaders, the applicable “CNP Safaris” Terms & Conditions govern the safari arrangements.
Clients will be informed which arrangement applies to their booking.
If there is any uncertainty about which Terms & Conditions apply, please contact DHP before making payment.
21.ACCEPTANCE OF TERMS
Payment of a deposit or any other amount toward a booking constitutes acknowledgement that the participant has received, read, understood and accepted the Terms & Conditions applicable to that booking.
